Unregistered leasehold property

When leaseholds are unregistered — and how first registration applies.

Leaseholds can be unregistered too

It’s not only freeholds. Longer leases granted or assigned before registration became compulsory can be unregistered, and some leasehold interests can be registered voluntarily.

Today, granting a lease of more than seven years, or assigning one with more than seven years to run, generally triggers compulsory registration. Older leases that predate this may still be unregistered — and registering voluntarily brings the same benefits of certainty and protection.

Class of title for leaseholds

A leasehold first registration may be granted as ‘good leasehold’ where the freehold title isn’t deduced — a specialist will explain what to expect for your lease.

Questions

Frequently asked

Should I register my unregistered lease?
If it has a long unexpired term, registering brings clarity and protection and makes future dealings simpler. A specialist can confirm whether registration is available and what class of title applies.
